  5. you grant iSpinner a worldwide, non-exclusive, royalty-free license to use, process and display your content.
  6. You agree to use the iSpinner service at your own risk
  7. iSpinner shall have no liability to you for content that you may find objectionable, obscene or in poor taste
  8. we reserve the right to terminate your account for any reason at any time and without notice
You understand that all warranties, express or implied, are disclaimed (including, but not limited to, the disclaimer of any implied warranties of merchantability and fitness for a particular purposes. iSpinner is not liable for any indirect, special, incidental or consequential damages (including damages for loss of business, loss of profits, litigation, or the like), whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. If you are dissatisfied with the iSpinner service or any of these Terms and Conditions, your sole and exclusive remedy is to discontinue using the iSpinner service immediately.

You agree to indemnify, defend and hold iSpinner and its partners, attorneys, employees, agents and affiliates harmless from any liability, loss, claim and expense including reasonable attorneys' fees, related to your violation of these Terms and Conditions, use of the iSpinner service, creation or use of a form, collection, possession or use of data derived from a form, or any service provided or performed or agreed to be performed, or any product sold by you, your agents, employees or assigns.

Any cancellation of your account will result in the deactivation or deletion of your account or your access to the account. Please be aware that iSpinner may for a time retain residual information and/or archival copies in its database.

You agree that these Terms and Conditions shall be treated as though they were executed and performed in Amsterdam, The Netherlands, and shall be governed by and construed in accordance with the laws of the Netherlands (without regard to conflict of law principles). All legal proceedings arising out of or in connection with these Terms and Conditions, Privacy Policy or any other agreement related to the use of iSpinner service shall be brought solely in Amsterdam (Netherlands).

If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitation set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement shall continue in effect.
